September-November

ILO action

  • Upon receipt of article 22 reports, and without entering into substance, the Office checks to see whether the reports contain:
    (a) replies to any comments of the Committee of Experts or conclusions of the Conference Committee;
    (b) information regarding the representative organizations of employers and workers to whom copies of the reports have been sent; and
    (c) the required documentation including laws and regulations which are not otherwise available. In cases of failures in these respects, the Office sends reminders to the governments concerned.
  • Observations from employers’ and workers’ organizations may be sent directly to the Office. The Office acknowledges receipt of the observations and simultaneously forwards a copy to your Government so that you may respond.

Action by national administrations

    Are you aware of the procedures in case of late submission of reports or comments due?

    Excellent!

    The Office sends reminders to governments that do not send their reports on time.
    Reminder: Your efforts to submit a timely report will contribute to the sound operation of the regular supervisory system. The report of the Committee of Experts contains information on non-compliance with reporting obligations.

    Are you aware of the procedures in case of failure to submit reports due?

    Excellent!

    The Committee of Experts reports non-compliance with reporting obligations to the International Labour Conference and the matter may be raised during it. Pending comments are repeated and governments are automatically required to prepare out-of-cycle report the following year.

    Do you know the procedures concerning observations, which are submitted directly to the ILO by employers’ and workers' organizations?

    Excellent!
    Reminder 1: Observations received by 1 September by the Office from employers’ and workers’ organizations will be submitted for substantive consideration by the Committee of Experts the same year. It is therefore important that you respond to these observations expeditiously so that the Committee of Experts is able to examine the situation on the basis of full information.
    Reminder 2: Observations received after 1 September will be noted in a comment by the Committee of Experts but will be examined in substance only the following year. You are well advised to provide your response in due time before that.
